2. Definitions
- Application: Azimutis, mobile applications, PWA and associated services.
- User: any person using the Application, whether free of charge or paid.
- Services: features offered by Azimutis.
- Content: data, projects, surveys, photos, reports, files, settings and exports generated or imported by the User.
3. Purpose
These Terms define the conditions for accessing and using the Azimutis Application.
4. Acceptance of the terms
Access to and use of the Application imply acceptance of these Terms. In case of disagreement, the User must not use the Application.
5. Access to the Application
- Access to certain Services requires account creation.
- The User undertakes to provide accurate and up-to-date information.
- The User is responsible for keeping login credentials confidential.
- Any action performed through the account is deemed to have been performed by the User.
6. Description of the Services
The Services offered include in particular:
- horizon profile and shading profile surveys,
- generation of curves and charts,
- irradiance analyses and energy indicators,
- production of reports and exports,
- data storage and synchronization.
The Services may evolve at any time.
7. Professional disclaimer
Azimutis is an analysis support tool. Results depend in particular on measurement conditions, entered settings, data used and User choices.
Azimutis is not a certified study, a regulatory sizing tool, or a guarantee of yield, performance or profitability.
The User remains solely responsible for decisions made based on results and documents shared with third parties.
8. Authorized use
- Use in accordance with the law and these Terms.
- Prohibition on disrupting service operation.
- Prohibition on attempting unauthorized access.
- Prohibition on reproducing or exploiting the Application without authorization.
9. Subscriptions and payments
- The Application offers free features and services accessible through a subscription offer.
- Subscriptions may be taken out:
- through third-party platforms (Apple App Store, Google Play Store);
- or by direct billing from the Publisher under a professional or enterprise license.
- When the subscription is taken out through Apple App Store or Google Play Store, payment, renewal, management and cancellation are fully handled by those platforms.
- In that case, Azimutis has no access to the user's payment methods and cannot directly cancel or refund the subscription.
- For direct billing, commercial, payment and duration terms are defined in the Terms and Conditions of Sale available at: https://azimutis.app/en/cgv.html.
- Access to subscription-based features may be suspended when the subscribed period expires or in case of non-payment.
10. User Content
- Content remains the property of the User.
- The User grants Azimutis a hosting and processing right strictly necessary for operation of the Services.
- The User is solely responsible for Content and warrants that they have the necessary rights.
11. Personal data
Personal data processing is described in the Privacy Policy: Privacy Policy.
12. Availability and evolution
- The Application is provided "as is".
- Interruptions may occur (maintenance, update, technical constraints).
- Azimutis may evolve, suspend or remove all or part of the Services.
13. Liability
Azimutis uses reasonable means to ensure proper operation of the service, without guaranteeing absence of errors, interruptions or suitability for a particular use.
Azimutis is a decision-support tool based in particular on data entered by the User and calculation models. The results provided are indicative and do not replace a full technical, regulatory or professional study.
The User remains solely responsible for interpreting results, decisions made and use of information produced by the Application.
Azimutis cannot be held liable in particular for:
- input or usage errors by the User;
- commercial, technical or financial decisions made based on the analyses provided;
- data losses attributable to the User or the User's technical environment;
- indirect damages, operating losses, commercial losses or loss of revenue.
14. Limitation of liability
To the extent permitted by law, Azimutis' liability is limited to the total amount paid by the User for subscriptions during the previous twelve months.
15. Account deletion
- The User may request deletion of the account from the Application.
- Deletion results in immediate account deactivation, loss of access to the Services and inaccessibility of Content.
- Deleting the Azimutis account does not cancel a subscription taken out through the App Store or Google Play.
16. Data retention and purge
- Deleted accounts are subject to logical deletion (soft delete).
- Data is no longer accessible to the User.
- Unless a contrary legal obligation applies, data is retained for a maximum period of 30 days, then permanently deleted or anonymized.
- Some data may be retained for legal obligations, security, abuse prevention, and accounting/evidentiary requirements.
- No recovery can be guaranteed after account deletion.
17. Evidence and logs
Technical logs, timestamps and computer records are binding between the parties, unless proven otherwise.
18. Force majeure
Azimutis cannot be held liable in the event of circumstances beyond its control preventing performance of the Services.
19. Assignment and subcontracting
Azimutis reserves the right to assign all or part of the Services and to use technical subcontractors.
20. Changes to the terms
These Terms may be changed at any time. Continued use of the Application constitutes acceptance of the updated Terms.
21. Applicable law
These Terms are governed by French law. Any dispute falls within the jurisdiction of the competent courts of the publisher's registered office, unless mandatory provisions state otherwise.
